Mutuals and Work Accidents
Permanent Disability from Work Accident
Financial benefit recognized when a work accident or occupational disease causes permanent limitations that reduce or nullify the ability to work. We analyze the correct qualification of the contingency as professional, assess sequels and functional limitations, and defend the recognition of the corresponding degree, both before the Mutual and before the INSS and the courts.
Work Accident Leave
Temporary disability situation derived from a work accident or occupational disease, with specific coverage and greater economic protection than common contingency. We intervene in case of discrepancies with the Mutual, improper medical discharges, delays in the payment of benefits, or controversies over the occupational nature of the accident.
Contingency Change
Procedure for a leave initially considered as common illness to be recognized as a work accident or occupational disease. This recognition can involve a higher financial benefit, employer responsibilities, and reinforced protection. We advise on administrative and judicial claims to achieve the correct qualification of the contingency.
Surcharge for Lack of Security Measures
Increase of between 30% and 50% on benefits when the accident occurs due to non-compliance with prevention measures by the employer. It is a direct and non-insurable responsibility of the company. We study the existing safety conditions, coordinate technical evidence, and exercise the corresponding claim.
Criminal and Civil Liability
When the work accident derives from serious infractions in risk prevention, additional criminal and civil liabilities can be generated to Social Security benefits. We assume the defense and claim for damages and losses, as well as the intervention in criminal proceedings related to work accidents.
